Opening hours:

Flower Nation operates from a residential home studio in Bull Creek, and does not have a shopfront with set opening hours, our consultations and pick ups are by appointment only. See above for contact information.

Amendments of Terms /Price changes/Styling inventory

We reserve the right to change, modify, add or remove portions of these terms at any time. If you have downloaded copies of our price/or inventory brochures, please note that the prices and qtys are subject to change. Please check our website regularly for the latest version to ensure you are aware of any changes.
Fresh blooms: Due to ever changing flower industry and transport issues, we may revisit cost estimates given more then 6 month ago, and may need to revise costings based on current prices. we will endevour to stay within the original budget, but may need to reduce some stem counts or advise of additional costs to keep to the original vision. Substitutions in fresh products occur frequently, and we will endevour to come as close to the colour palette and theme chosen. We ask you to trust our knowledge and experience when making these substitution.

Limitation of Liability

It is an essential condition to you using our website that you agree and accept that Flower Nation is not legally responsible for any loss or damage you might suffer related to the use of our website. Whether from errors or from omissions in our documents or information, any goods, or services we may offer or from any other use of the website. Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services, or information available through this website meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Hire items from REALflowersforHIRE

All hire items & terms and conditions will be clearly stated on your individual HIRE agreement.
Any broken, damaged or lost items will be charged at the full recommended retail price (RRP) and as per appendix 1 of your HIRE agreement which outlines full costs.
We may also reserve the right to charge a bond depending on certain circumstances, venues.
Please refer to all HIRE conditions within your HIRE agreement and FAQ on website relating to more specific questions.

Flower Nations Obligations

  1. FN will provide the Hirer with a document regarding the care, handling and limitations, storage and/or proper and appropriate use of the hired items.
  2. FN is responsible to ensure that all Hire stock is delivered & set up at the specified times and locations as set out in your individual hire contract..
  3. It is FN responsibility to ensure that all Hire stock is free of damage, looking its best and suitably installed/set up.
  4. All Hire items are checked by FN staff, after they have been returned from previous events as well as when they are delivered/set up & collected from your event with above specified date.
  5. In the unlikely event that Flower Nation is unable to fulfil the order for reasons including, but not limited to, force majeure, illness, accident, or injury, I reserve the right to cancel the order and refund all monies paid prior to this date. All reasonable care will be taken to mitigate impact.

Your obligations and liabilities as Hirer

  1. Acknowledgment of the nature of the product and variations within the items. Although great care has been taken to make all the multiples of an item as similar as possible, the ingredients are a natural product and therefor exact copies cannot be achieved.   2. WET WEATHER restrictions: In the circumstance that it is forecast to rain on your event date you agree to move indoors at the discretion of Flower Nation. We will be discussing this option with you a few days prior to the event if the weather looks inclement.  The flowers and foliage are humidity sensitive and will damage when used in moist environments. You will be liable for replacement costs. There will be circumstances that might be considered an exemption, please contact us to discuss.
  3. Sparklers, Candles, and Fireworks: Dried flowers are extremely flammable, and are not permitted to be used with any kind of firework closer then 3 m (even the “cold flames”sparklers). If clients own candles are used, they must be LED unless florals are enclosed (like the terrarium). Candleholders that are set up by FN staff must not be moved to ensure there is no fire risk.
  4. Changes and Cancellations: Should you need to cancel an order, adjust the hired quantities, or make changes to items selected as specified in the accompanying cost estimate, you shall advise FN as soon as it becomes apparent, via email to katharina@flowernation.com.au or phone 0404 515
    1. Between signing of agreement and 30 days prior to the event – Flower Nation will endeavour to facilitate these changes and adjust costs accordingly, but approval of changes cannot be guaranteed.
    2. For changes less than 14 days prior to the above set event date, FN will invoice the original amount as per individual cost estimate for the specific event, unless changes result in an increased total amount.
    3. Cancellations. If you need to cancel an order, please contact FN immediately on 0404 515 141. Everything except an administration fee (based on the hours of work already spent on client related activities) will be refunded if cancellation is given in writing no later than 30 days prior to the date specified above. If cancellation is received less than 30 days prior, refund terms are at the discretion of FN.
    4. COVID19- If your event cannot go ahead because of a lockdown,
      1. we will endeavour to move your HIRE order to a postponed date (subject to FN availability) without incurring any costs (unless there is a FRESH flower portion of the order in which case you will still be liable to pay for the fresh blooms).
      2. Between signing of agreement and 30 days prior to the event – Flower Nation will endeavour to facilitate these changes and adjust costs accordingly, but approval of changes cannot be guaranteed.
      3. If client decides to not reschedule the date within the next 12 month- you will be refunded all monies except the initial date retainer.
  5. Multiple Locations, Repurposing: Please note, our pieces are not permitted to be moved by the individual Hirer or related parties. Some venues, companies or planners may be given prior approval to move the hire range depending on circumstances and items. a) If an event is split in locations – such as a ceremony held at a different venue to the reception – our staff will either wait or return to your event to dismantle and reassemble the pieces at the second venue. This cost will be included in your initial quote.
  6. Damage, Loss, Theft. You shall be liable on behalf of your clients to FN in the event of any damage, missing items, loss or theft of the hired items.
    1. Damage: If upon Pickup any hired items are found damaged and/or soiled, FN shall assess whether they can be returned to pristine condition on a cost-effective basis. If FN is satisfied that this can be achieved, it shall charge you the costs incurred in doing so. If it is not satisfied that this can be achieved, but instead considers that replacements are necessary, it shall charge you the full replacement cost as per appendix 1.
    2. In case of missing items, you will be given a leniency of 24 hours to locate the items and return them to FN. Please see Appendix 1 of your HIRE agreement for a comprehensive list of replacement costs for individual items. Depending on the severity of the damage to the hire item the repair or replacement value will be invoiced to you. It is your responsibility to communicate this to your clients and make them aware of replacement costs in case of damage.
  7. Modification/repair: You shall not alter or modify the hired items in any manner whatsoever, nor shall you attempt to repair any damage to them. Any alteration or modification which you make to the hired items shall be deemed to be damage to them and will be charged according to section 5.4
  8. Third party use: Where your use of the hired items involves them being utilised by third parties (for example hire by event planners, function venues, photoshoots or filmed advertisements), this does not diminish your responsibilities and obligations under this agreement to any extent whatsoever, and you shall be deemed the Hirer within this agreement. You agree to indemnify FN in respect of all claims made by third parties who suffer or claim to suffer any damage or injury arising from use of the hired items during the hire period.
  9. Your rights in relation to the hired items are strictly those of a mere bailee, with the right to use them during the hire period in accordance with the terms of this agreement. You acknowledge and agree that the hired items remain the property of FN at all times, and you shall not at any time or in any way whatsoever do anything or make any representation (including by way of silence) contrary to FN ownership of them.
  10. Waiting time in the case where our staff is left waiting and cannot move flowers because wedding is delayed, or other circumstances, where timings discussed are not adhered to by hirer, we reserved the right to charge extra time spent onsite via invoice after the event.

Delivery, set up, pack down /pickup details

Please ensure that the addresses you have provided in the order/or contract documents are up to date.
For weddings, our delivery and set up  fees can be found on the relevant pages, downloadable documents.
For Shop items these vary by location (within 20km ) are are added at checkout. Pick up from Bull Creek can be arranged.

Minimums, Bookings & Payments

  • Minimums:
    For REAL flowers for HIRE , we have a minimum floral HIRE requirement of $250 (not including delivery, set up and pickup)unless otherwise agreed upon.
    For fresh floral events: we have a minimum of $1000 but only take on a limited amount of events in 2023/24 as we focus on growing our passion project REALflowersforHIRE.
  • Bookings:
    Are only confirmed when the scanned paperwork has been sent back as well as a non refundable retainer fee (based on a sliding scale and within our contract) has been paid. Bookings are transferable to another date (subject to availability) no later than 120 days prior to the delivery date of the specific booking.
  • Payments:
    For event booking a retainer fee is needed aswell as a filled and signed contract to confirm your booking.
    All balance payments are due before or at 30 days prior to event date.
    Preferred method of payment is bank transfer , but credit card payment can be arranged via paypal or  Square (surcharge of 1.9%).

Photography

Any photos that are taken by FN/staff of your event may be used in our Marketing Materials/website/social channels unless specifically advised by the client.
All professional photos provided to us, by you, your photographer or wedding guests may also be used, but credit will be endeavoured to be given.
We take no responsibility for any unlawful use of photographs that are taken from our social media and website without our approval.

Refunds/ Returns

Flower Nation handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.
Products sold on this website and by this business are a perishable, natural item,
as a result, not all goods produced are as pictured on Fresh Floral Studio’s website.
By accepting these terms and conditions you are acknowledging there may be discrepancies between images & produced goods.
We will always work with you to rectify a problem, so please remember:-
we are dealing with fresh & delicate products;

Delivery of SHOP items

If you have selected delivery for any SHOP items, we will endeavour to touch base with you and arrange a suitable time, date on the contact details provided at checkout..
If we cannot make contact or our contact is not returned, we cannot do the above.
We reserved the right to:
Leave your order in a safe place at the specified address that is weather protected.
Return your order to the store and you will have to pay again for re delivery or collect yourself, if we are unable too gain access to the property due locked gates/animals,
Leaving the ordered item at an incorrect address, should the address supplied on the order be incorrect, we do not take responsibility.
We rely on Google maps to find you so please leave us with instructions if the address is new, or if there is any specific instructions.

Exclusion of Competitors

If you are in the business of creating similar products, goods or services for the purpose of selling them or providing them for a fee, then you are a competitor of Flower Nation.
Flower Nation does not permit you to use or access its website, www.flowernation.com.au, to download any photos or information from its website or obtain any such documents or information through a third party.

We may from time to time provide on our website, links to other websites and information on those websites for your convenience. This does not necessarily imply sponsorship, endorsement, or approval or arrangement between Flower Nation and the owners of those websites. We take no responsibility for any of the content found on the linked websites.
